David Cornes |
| David is a full-time independent commercial mediator. Until 31 December, 2004, he was Senior Partner of Winward Fearon, Solicitors, London. He was a civil engineer for 10 years before becoming a solicitor. He is a Fellow of the Institution of Civil Engineers and a Fellow of the Chartered Institute of Arbitrators where he is a mediator representative on the Board of Management. He was accredited by CEDR in 1993 and is a member of numerous mediation panels, including the Court of Appeal Panel. He has conducted mediations involving sums up to £80 million and involving multiple parties. Many have involved parties and lawyers from outside the UK (including China, Finland, France, Germany, Hong Kong, Indonesia, Italy, Malaysia, Malta, The Netherlands, Russia, Slovakia, Singapore, Sweden, Switzerland, Thailand, Venezuela and the USA). The types of disputes that he has mediated include: accidents in construction, boundary disputes (party walls), business disputes (partnerships and family controlled companies), commercial contracts, construction (most types of dispute, including payment, termination, liquidated damages, delay and defects in design and construction), defamation, environmental, EU competition/procurement, information technology, insolvency, insurance (& reinsurance), intellectual property, mechanical & electrical engineering, multi-party disputes, nuisance (e.g. building damage), oil and gas (including damage and loss), petrochemical, power (electricity), professional fee disputes, Private Finance Initiative projects, product liability, professional negligence (the construction industry professions and others, including property valuation claims), property (real estate), railway industry, shipping (wet) and term maintenance contracts in various industries. He is a member of the Technology and Construction Court Solicitors Association. He is on the ICE List of Dispute Resolution Board members. He also acts as conciliator under the ICE Conciliation Procedure and the similar Procedure published by the Institution of Engineers of Ireland, as well as, under the Construction Conciliation Group scheme. He is the author of two law books: Design Liability in the Construction Industry and Collateral Warranties.
